EXPUNGMENT FROM THE CENTRAL REGISTRY FOR NEGLECT AND ABUSE:

In all child neglect and abuse case that result in court action and in some referral cases that do not result in court action, a parent who has been accused of neglecting or abusing his/her child will have their names placed on the Child Abuse Central Registry. You can have your name expunged from this list if the following apply to you:

1.  If your name is placed on the registry as a result of being classified as a Catagory III or IV, your name must be expunged.

2.  If your name is place on the registry as a result of being classified as a Catagory II, your name must be expunged unless your child suffered a physical injury and court action was taken and dismissed, then your name can be expunged if there is only one incident within a period of 5 years.

3.  If your name is place on the registry as a result of being classified as a Catagory II, III, or IV approximately ten years ago and you were told that your name would be automatically expunged after the child turned 18 years of age. You will probably need an expungement hearing, the law changed during this period of time and there are no automatic expungements. More than likely, your name still remains on the Central Registry.
